1 GENERAL

1.1These Terms and Conditions (“Terms”) apply to any general enquiry or registration for and participation in the Green Homes Finance Accelerator Project.
1.2A general enquiry or registration of interest in the Green Homes Finance Accelerator can be made via our website using the link referred to in these Terms.
1.3Please read these Terms carefully before you register for and participate in the Project as they set out important information about your and our rights and obligations.
1.4You must agree to these Terms before you enquire or register your interest.
1.5You must be at least 18 years old and a resident of the UK to enquire or register your interest in and participate in the Green Homes Finance Accelerator.
1.6If there is anything you do not understand about these Terms, please contact us so we can provide clarification.

4 THESE TERMS

4.1Any reference to ‘we’, ‘us’ or ‘our’ in these Terms is to Heatio, and any reference to ‘you’ or ‘your’ is to the person enquiring or registering interest on our website.
4.2We may make changes to these Terms at any time. However, the Terms which apply to you will be those in force at the time you enquired or registered your interest.

5 INFORMATION ABOUT THE PROJECT

5.1The Project concept is government backed and is part of a government initiative called the Green Home Finance Accelerator. The Project is designed to address the multiple barriers to the adoption of low carbon technology and support consumers to achieve an accessible and cost-effective transition to net zero and affordable energy bills without incurring capital costs. The Project will provide a point of access to our Home Energy-Saving Solution (subject to eligibility criteria) and monitor and evaluate the Home Energy-Saving Solution. 5.5The Project runs from June 2024 to 28 February 2025.

6 INFORMATION ABOUT THE HOME ENERGY-SAVING SOLUTION

6.1 The Home Energy-Saving Solution is a service brought to market by us through the Project for the:
  • Supply, installation and maintenance of a domestic Solar PV & Battery System, monitoring and optimisation via a monthly payment plan in partnership with Hometree Finance.
  • Supply and installation of a Heat Pump Heating & Hot Water System and System.
6.2The Home Energy-Saving Solution will not create ownership of the Solar PV & Battery System. This will be owned by Hometree Finance. However, the Heat Pump Heating & Hot Water System will be owned by you in accordance with Boiler Upgrade Scheme requirements. More information about this will be given to you when you apply for the Home Energy-Saving Solution.
6.3The number of installations under the Home Energy-Saving Solution is limited. Therefore you accept that even though you may register your interest for the Home Energy-Saving Solution , there is no guarantee that you will be selected to proceed to contract with us and the associated installation of Energy Efficiency Measures.

7 THE ORGANISATIONS INVOLVED WITH THE PROJECT AND THEIR ROLES

7.1 Heatio Limited (“Heatio”) is a company registered in England and Wales under company number 14044906 whose registered offices are at: Edward Pavilion, Royal Albert Dock, Liverpool, England, L3 4AF.
  • Heatio will be responsible for the delivery of the Home Energy-Saving Solution and the end-to-end customer journey under the Home Energy-Saving Solution and all associated contracting with you including but not limited to: a feasibility & technical suitability assessment, a financial suitability assessment (including credit check), MSC compliant system design and installation, a Home Energy-Saving Solution quote and all ongoing services and liability.
7.2 E.ON UK Green Funding Solutions Limited (“E.ON”), a company registered in England and Wales under company number: 02730697 whose registered office is at: Westwood Way, Westwood Business Park, Coventry CV4 8LG.
  • E.ON has developed an energy tariff named the Next Eco Reward tariff. This has been designed to complement the Home Energy-Saving Solution. The Next Eco Reward tariff is in no way contractually connected to the Home Energy-Saving Solution and you do not have to take up the Next Eco Reward tariff to gain access to the Home Energy-Saving Solution.
  • Should you choose to proceed with the Next Eco Reward tariff, this will be subject to separate terms and conditions.
7.3 The Department for Energy Security & Net Zero (“DESNZ”) whose departmental address is 55 Whitehall, London, SW1A 2HP.
  • DESNZ are the government department backing the Project.
7.4 Energy Systems Catapult (“Catapult”), a company registered in England and Wales under company number 08705784 whose registered office is at: 7th Floor, Cannon House, 18 Priory Queensway, Birmingham B4 6BS. Their email address is info@es.catapult.org.uk.
  • Catapult are the appointed research organisation for the Project.
7.5 Heatio, E.ON, DESNZ and Catapult are collectively referred to in these Terms as “the organisations involved with the Project”.

8 THE ELIGIBILITY CRITERIA FOR THE PROJECT

8.1 In order to be eligible for participation in the Project you must:
  • own your home;
  • not have any existing low carbon solutions in place;
  • agree to be contacted by the organisations involved with the Project to be invited to take part in consumer insight surveys and interviews to improve our service and share anonymised findings with the organisations involved with the Project regardless of our decision to accept your registration on to the Project, our decision to accept you on to the Home Energy-Saving Solution, or your decision to participate in the Home Energy-Saving Solution;
  • have a smart meter that has been installed for at least 13 months; and
  • have a gas combi-boiler installed in your home that acts as your main source of heating.
8.2 Places on the Project are limited and we cannot guarantee that a place on the Project will be available at any given time and in circumstances beyond our reasonable control. If this happens and it affects your registration, we will notify you by email or by phone.
8.3 You must meet all of the criteria set out in Section 9 to be eligible for the Project. However, meeting the criteria will not guarantee you will be accepted on to the Project or the Home Energy-Saving Solution.

9 YOUR OBLIGATIONS REGARDING YOUR PARTICIPATION IN THE PROJECT

9.1 In order to participate in the Project, you must:
  • agree to these Terms;
  • register for the Home Energy-Saving Solution using the following link www.heatio.com and
  • agree to additional terms and conditions provided by us.

10 The Energy Efficiency Measures

10.1 The “Energy Efficiency Measures” are supplied as part of the Home Energy-Saving Solution. They comprise of:
  • A complete package of Solar PV & Battery System under a lease agreement with Hometree Finance. The equipment is Hometree Finance's property. You get all the benefits of the system, including energy generation, storage, plus any payments relating to surplus energy generated by the system, such as under the Smart Export Guarantee.
  • A Heat Pump Heating & Hot Water System owned by you in accordance with Boiler Upgrade Scheme requirements.
  • A monitoring and optimisation service via Heatio’s Home Energy Optimisation Platform.
10.2 If you meet the eligibility criteria set out in Section 9, are successfully accepted for the Home Energy-Saving Solution by us and consent to the obligations set out in our terms, you may be selected to proceed with a technical survey of your property and the installation of the Energy Efficiency Measures along with maintenance and optimisation services.
10.3 You must consent to the installation of the complete package of Energy Efficiency Measures.
10.4 You accept that the Energy Efficiency Measures are subject to a survey and you may not be eligible to receive them.
10.5 We have no liability to you in relation to the Energy Efficiency Measures. All faults relating to the Energy Efficiency Measures must be notified by contacting the following:
  • For any faults relating to the Solar PV & Battery System you must contact Hometree Finance on 0800 987 1789 or email hello@hometreefinance.co.uk and they will arrange for an engineer to visit your home as soon as possible. The cost of repairs or replacement (including parts and labour) will be covered for the duration of your monthly payment plan, with no callout fees or excess.
  • For any faults relating to the Heat Pump and Hot Water Storage System you must contact Heatio on 0151 540 3998 or info@heatio.com and they will arrange for an engineer to visit your home as soon as possible.

11 YOUR DATA

11.1 We rely on information and data which is provided by third parties to understand your energy usage and expenditure to provide you with a bespoke energy saving plan and recommendations, suitable for your unique property and situation.
11.2 We gather:
  • Energy consumption and generation information for both gas and electricity (where available).
  • Energy tariff information containing information of the price you are charged for energy consumed.
  • Information identifying the energy meter (number, location, type).
The granularity of data gathered is of 30-minute intervals.
11.3 We are not liable for any inaccuracies in such energy usage or expenditure data. The smart meter data is stored for up to 5 years, securely and separately from your personal information. If you wish for us to remove your personal data or remove consent for collecting your smart meter data, please contact us at info@heatio.com
11.4 N3rgy data service (https://n3rgy.com) is used by HEATIO to interface with the national smart meter systems in order to collect, store, manage and share with HEATIO your Smart Meter data. This service uses the Smart Energy Code (https://smartenergycodecompany.co.uk/) Party credentials and Party ID of N3RGY LIMITED, incorporated and registered in England and Wales with the company number 11203504 whose registered office is at 4 Ovington Drive, Fleet, United Kingdom, GU51 1DF.
  • n3rgy data - accessing smart energy data: Easy, secure and scalable access to smart energy data from millions of smart and advanced meters, as well as other smart devices.
  • Smart Energy Code: The Smart Energy Code (SEC) is a multi-party agreement which defines the rights and obligations of energy suppliers, network operators and other relevant parties involved in the end-to-end management of smart metering in Great Britain.

12 ENQUIRING AND REGISTERING FOR THE PROJECT

12.1If you meet the eligibility criteria in Section 9 and accept these Terms you will be eligible to register for the Project.
12.2After you have registered your interest in the Project with us, we will call you or send you an acknowledgement email to let you know that we have received it. This does not mean that your registration has been accepted by us.
12.3Acceptance of your registration for the Project by us takes place when we contact you via telephone or email to confirm that you have been successfully qualified for the Project. We will provide you with further instructions on the application process for the Home Energy-Saving Solution.
12.4If we do not accept your registration, for example: because the number of applicants eligible for the Project has reached its capacity; you are under 18; you live outside of the UK; you do not meet the eligibility criteria set out at Section 9; or for any other reason, we will email you using the details you provided when you initially registered. We have the right to reject any registration for any reason.
12.5Once you have accepted these Terms and your registration has been accepted by us a legally binding contract is formed between you and us.
12.6If you would like to make any changes to your registration after you have submitted it, please contact us as soon as possible using the details set out in Section 3 of these Terms.
12.7If you have registered for the Project but have changed your mind, please contact us immediately using the details set out in Section 3 so we can make the relevant arrangements to remove you from the Project.

13 WITHDRAWING FROM THE PROJECT

13.1If you wish to withdraw from the Project, you must inform us before entering into your Home Energy-Saving Solution contract and before receiving any Energy Efficiency Measures.

14 EVENTS BEYOND OUR CONTROL

14.1We are not liable for failure to comply with these Terms due to circumstances beyond our reasonable control.

15 OUR RESPONSIBILITY TO YOU

15.1Our total liability to you in relation to the Project shall not exceed £250 (two hundred and fifty pounds). We shall not be liable for (whether in contract, tort breach of statutory duty or otherwise) any loss of profit, indirect or consequential loss arising in connection with the Project.
15.2We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
15.3We are not liable for losses not caused by us, or losses that were not foreseeable.
15.4Nothing in these Terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.

16 NO THIRD-PARTY RIGHTS

16.1No third party has any right to enforce any of these Terms.

17 TRANSFER OF RIGHTS

17.1We may transfer our rights under these Terms to another business without your consent, but we will notify you of the transfer, and make sure that your rights are not adversely affected as a result.
17.2You are not allowed to transfer your rights under these Terms to anyone without our prior written consent.

18 COMPLAINTS

18.1If you are unhappy with us or any part of the Project that we are responsible for please contact us at info@heatio.com or 0151 540 3998.

19 GOVERNING LAW AND JURISDICTION

19.1The laws of England and Wales apply to these Terms and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
